Privacy Statement

This Privacy Statement (“Statement”) explains how theluxboho and its subsidiaries (“we,” “us,” “our”) collect, use, process, and disclose information about you when you visit or place an order through our branded websites (the “Websites”), or when you interact with us in other ways—such as in-store, at events, via customer support, or on social media.

The information we collect depends on how you engage with us. Below are the categories of data we collect and where it comes from.

1) Information You Provide

We collect information you submit directly—for example, when you create an account, complete a form, post a review, make a purchase, contact support, or participate in promotions, sweepstakes, or surveys.
This may include: your name, email address, phone number, username and password, date of birth, billing and shipping addresses, and any photos, videos, stories, or other content you choose to share. For purchases, a third-party payment processor collects and processes your payment details on our behalf.

If you use our professional/partner portals (“Pro Sites”), we or our verification providers may request additional information to verify eligibility (e.g., a work email or images of pay stubs).

2) Information We Collect Automatically

We automatically collect certain information about your interactions, including:

  • Transactional data: product details, purchase price, date and location of transactions/returns.
  • Device & usage data: IP address, login info, browser type/version, plug-ins, operating system, platform; site activity such as clickstream, errors, time on pages, and page interactions.
  • Cookies & similar tech: cookies, web beacons, and similar tools to measure email engagement, improve our Websites, understand popular features, and count visits. See Cookies & Other Tracking Technologies below for your choices.
  • Video & images: in-store CCTV/photography for security, fraud, and loss prevention.

3) Information From Other Sources

We receive information from third parties, such as social platforms (if you connect accounts), identity verification services, advertising and analytics partners, market research firms, mailing list providers, data co-ops, wholesale partners, and event sponsors. This may include contact details, prior purchase history (from other companies), and product preferences, as well as event participation details.

4) Inferences We Derive

We may infer information from other data—e.g., approximate location from IP, or interests from browsing behavior and past purchases.

5) How We Use Information

We use data to operate our Websites and deliver your orders. We also use it to:
a) provide, maintain, and improve products and Websites;
b) personalize your experience;
c) send technical notices, security alerts, support and transactional messages;
d) communicate about products, services, and events from theluxboho, our wholesale partners, and other event sponsors, and share news we believe may interest you (see Communications Preferences for opt-out info);
e) run and administer loyalty programs;
f) monitor and analyze trends, usage, and activities;
g) show ads tailored to your interests on third-party sites/apps (see Targeted Advertising & Analytics for opt-out options);
h) manage contests, sweepstakes, promotions, and fulfill entries/rewards;
i) detect, investigate, and help prevent security incidents, fraud, and illegal activities; protect the rights and property of theluxboho and others;
j) comply with legal/financial obligations; and
k) for any other purpose disclosed at the time of collection.

Targeted Advertising & Analytics

We work with others to provide analytics, serve ads, and perform related services across the web. These parties may use cookies, web beacons, device IDs, and similar technologies to collect information (e.g., IP address, browser, pages viewed, time on page, links clicked, conversions) to deliver interest-based ads and measure effectiveness. Some partners convert your email/phone into a non-identifying token to reach you with more relevant ads. Disclosures of Information

We may disclose (or allow others to collect) the categories of personal information described above as follows:

  • Vendors/Service Providers/Contractors/Consultants that support hosting, shipping, payments, fraud prevention, customer service, marketing/advertising, etc.
  • Store location tools: if you allow location access, integrated partners may collect that data directly.
  • Marketing expansion: we may disclose contact details (e.g., postal or email) to third parties for their own marketing or to extend our reach (e.g., data co-ops, mailing list providers). In some locales, this may be considered a “sale.” See Opting Out of Targeted Advertising, Sharing, and Sales.
  • Legal & safety: to comply with law or legal process (including lawful government requests), enforce our terms, prevent harm or illegal activity, or protect theluxboho, users, the public, or others.
  • Professional advisors: lawyers/auditors as needed.
  • Business transactions: in connection with a merger, asset sale, financing, or acquisition.
  • With your consent/direction: e.g., public reviews or content you post on our Websites.

We may also share aggregated or de-identified information that does not reasonably identify you. We maintain and use such information in de-identified form and will not re-identify it except as permitted by law.


Your Privacy Choices & Rights

1) Access, Correction, Deletion

Depending on your location, you may have the right to request: (i) access/portability of your personal information; (ii) deletion; (iii) correction of inaccuracies; and (iv) other rights afforded by applicable law.
To submit a request, please use the contact methods provided on our Websites (e.g., Support or Privacy Request forms). You can also access, correct, or delete certain account information by logging in.

To protect your data, we may verify your identity (e.g., by requesting information about recent interactions). If we deny your request, you may appeal by contacting us through the channels listed on our Websites. You may also contact your local authority if you have concerns regarding an appeal outcome.

2) Opting Out of Targeted Advertising, Sharing, and Sales

As noted above, certain data activities may be considered “targeted advertising,” “sharing,” or “selling” under applicable laws. Where available, you may opt out via Your Privacy Choices links or tools offered on our Websites.

3) Non-Discrimination

We will not discriminate against you for exercising your privacy rights.

4) Cookies & Other Tracking Technologies
